The 2% maintenance fund and the monthly management fee are two different things
But honestly, I signed my first handover minutes without understanding both money lines. One line was the maintenance fund, while the other was the management fee. Because everyone behind me was queuing for keys, I just nodded.
Then three years later, the lift in our block broke. So residents finally sat down to ask where the repair money was. Still, only at that point did I understand something. In fact the two amounts cannot stand in for each other.
So today I am answering the questions women ask me most. Meanwhile the figures come from a 68 square metre flat at 2.1 billion dong.
What the apartment maintenance fund is, and why it is exactly 2%
Because of Article 152 of the 2023 Housing Law, a maintenance fund exists. So the buyer pays 2% of the apartment value. Also, it is calculated separately from the sale price. Therefore it must be written clearly into the purchase contract.
For example, take the flat of Thu, 41, who runs a small bakery in Binh Thanh. Since her unit is 68 square metres at 2.1 billion before tax, the maths is easy. So the apartment maintenance fund is 42 million. Still, she pays it once at handover rather than every year.
In fact many women assume those 42 million sit inside the 2.1 billion. They do not. Instead it is an addition. So when you total the cash needed on handover day, include it. Likewise you include the items in the inspection before you sign.
Where the apartment maintenance fund and the management fee differ
Certainly this is the question I get most. Also, it is where money leaks fastest. Because the maintenance fund is capital, it repairs and replaces common equipment. Namely lifts, water pumps, fire systems, the roof and the outer walls.
The management fee, however, is something else. It covers monthly operation instead. For example security, cleaning, corridor electricity, wages and rubbish collection. Because that money is consumed within the month, it leaves nothing behind.
Still, the law states one thing plainly. Therefore the management board cannot spend the fund on operating costs. So if somebody proposes dipping into it, speak up.
How the management fee is calculated, and where the official bracket sits
First, the fee is charged per square metre of floor area each month. Then you multiply by the size of your unit. Since provincial authorities issue a reference bracket, the level differs by place.
For example Hanoi allows 1,200 to 16,500 dong per square metre with a lift. Without a lift, however, it runs from 700 to 5,000. Meanwhile Da Nang sits at 4,400 to 13,200 with a lift. Also, Dak Lak under Decision 71/2026 allows 8,600 to 13,400.
So at 8,000 dong, Thu’s 68 square metres cost 544,000 a month. In short that is 6.528 million a year. But at 16,500 the figure becomes 1,122,000 a month. Therefore the yearly cost is 13.464 million. So the gap is 6.936 million every year. Obviously that comes from one line in a service contract.
Therefore ask for this number before you put down a deposit. Also ask it alongside the costs that keep arriving monthly.
Where the apartment maintenance fund sits before a management board exists
First the developer collects it at handover. Then the money must go into a separate account. Also, it cannot be mixed into trading money. Later the residents’ general meeting elects a management board. After that, the developer must transfer the fund across.
So multiply it out to see why handovers get disputed. For example, take a 300 unit block averaging 2 billion a flat. Then the fund is 300 times 40 million, namely 12 billion. Obviously that is not a small sum.
Now suppose 12 billion sits in the bank at an assumed 5% a year. So the interest is 600 million annually. Because that interest belongs to the fund, not the holder, ask for the books.
What the residents’ general meeting actually decides
Firstly, owners elect the management board at that meeting. Also, they set the management fee within the local bracket. Then they pick the company that operates the building.
Although it sounds administrative, it is the meeting that sets your bill. So it decides whether you pay 544,000 or 1,122,000 a month. Therefore being absent means letting other people decide for you.
Similarly it mirrors the mistakes first-time buyers keep making. Because money rarely leaks at purchase, it leaks afterwards. In fact it leaks in the small things you ignore.
Three questions to ask about the apartment maintenance fund before signing
First, how much is the fund for your unit? Also, which clause of the contract records it? Because you need the actual figure, a reassurance is not an answer.
Second, which account and which bank holds the money? Third, when is the residents’ general meeting expected?
Truly those three questions take two minutes to ask. Still, ask them in writing and keep the reply. Therefore you are protecting 42 million of your own money.
Start Today
First open your purchase contract and find the maintenance fund line. Then save that number in your phone. Or if you are renting, note the per square metre fee instead.
Finally, knowing those two numbers puts you ahead of most residents in your block.
